It is generally a good idea to consult with a lawyer if you have sustained injuries, even if they appear minor (most California personal injury attorneys, including us, offer a free initial consultation). You should contact an attorney as soon as possible after the accident, particularly if serious injuries are involved. This allows your attorney to interview witnesses, obtain evidence, determine insurance coverage and communicate with the insurance company on your behalf. You can then concentrate on recovering from your injuries.

After an accident, the other driver’s insurance company may reach out to you with a monetary offer. While the offer may seem appealing considering you may be too injured to work, it is important to know what is really going on: Insurers offer these settlements to minimize the amount they have to pay. By accepting a settlement, you would likely be giving up any rights to file a lawsuit in the future. In other words, it is wise to speak with a lawyer before accepting any insurance company’s offer.

California follows a system called “pure comparative negligence.” It gets complicated but boils down to this: An injured person can file a lawsuit and recover compensation, even if he or she was partially at fault for the accident. The final damage award you receive will be reduced by the percentage of your own fault. Your percentage of fault is determined by evidence such as eyewitness testimony and testimony from accident reconstruction specialists.

In California, personal injury cases must be filed within two years from the date of the accident. For wrongful death cases, the claim must be filed within two years of the date of death. It is best to consult an attorney soon after the incident rather than wait until two years is almost up because evidence can disappear and witnesses may move away, making the claim harder to prove.

There is no set number that applies to any case. Rather, every case is evaluated based on the specific circumstances of the accident, the severity of the injuries and the effects of those injuries on the victim. One thing, however, is consistent in every case: You are likely to recover more with an attorney on your side than if you try to handle the situation on your own.

Most personal injury lawyers in California, including us, handle cases on a contingency fee basis. This means you do not pay the attorney’s fees out of your own pocket. Instead, the lawyer receives a percentage of any eventual recovery. If the lawyer fails to obtain compensation for you, you do not owe a fee. In either scenario, you will be responsible for paying certain expenses, such as court fees that the lawyer incurs while working on the case.
